Workers Compensation Injury

If you are injured at work, you must be certain the details of your injury are all thoroughly documented by you and your employer within thirty days of the injury.

It is important to have a medical evaluation which may involve going to the hospital and/or scheduling an office visit with a physician depending on the severity of your condition. Your doctor will have to perform a comprehensive medical exam which may include MRI's, X-rays and other tests. The results of your assessments should be properly documented. Once your doctor determines a diagnosis, it will be decided whether you are to be restricted from working, released to work in some capacity, or whether you are capable of returning to your usual duties. This determination, along with supporting evidence, is required for your worker's compensation claim.

Residing in New York State, it is important that you select a physician that is certified by the State Workers' Compensation Board. Furthermore, due to the documentation involved, be certain you select a doctor who has experience in workers' compensation claims, since the physician is required to make evaluations regarding your level of disability under the NYS workers' compensation guidelines.
